Flexible working is a great way to motivate and retain your employees. However, a poorly implemented flexible working policy can quickly lead to disputes.

Our highly experienced team of over 30 employment lawyers can provide you with practical legal advice and representation if an employee raises a complaint over flexible working.

Some of the possible outcomes we can achieve for you

  • Advise on the options you can pursue to resolve the grievance.
  • Review and advise upon flexible working policy changes.
  • Representation and guidance should the complaint be taken to an Employment Tribunal.
  • Here are some important things you should be aware of if an employee raises a flexible working complaint against you:

    • Employees who have worked with you for at least 12 months can request flexible working arrangements if they meet certain criteria, including but not limited to; the employee is disabled, aged 55 or older, a carer, or experiencing family or domestic violence.
    • If you receive an employee request for flexible working, you must provide a written response within 21 days saying whether the request is granted or refused.
    • As an employer, you can only refuse a request based on reasonable business grounds.
    • If your employee is not satisfied with your reasons for refusing a flexible working request, they may decide to bring their case to an employment tribunal.

    How much will it cost?

    Legal Expenses Insurance (LEI)

    If you have a commercial insurance policy which includes Legal Expenses Insurance (LEI) cover, your legal costs may be covered by your policy (subject to the terms and conditions of the policy). If you are unsure if your insurance policy includes LEI cover, we will check this with you.

    Commercial LEI

    No Legal Expenses Insurance

    If you do not have this cover we offer fixed fees and discounted hourly rates. Our employment law specialists will be happy to explain these options to you.
