Disputes with brokers

How DAS Law can help you

Our experienced team of dispute resolution lawyers will provide you with practical legal advice if you have a legal dispute with a broker.

These are some of the outcomes we can achieve for you:

  • Compensation for losses due to the broker’s negligence.
  • Repayment of the fees paid to the broker.
  • Important things to consider

Here are some important things you should be aware of regarding your legal problem:

    • Proving that a broker was negligent can be challenging.  You must show that no reasonably competent broker would have given the advice your broker gave or would failed to give certain advice.
    • Proving negligence will often require compelling expert evidence from another similarly qualified broker who is prepared to stand up in court if necessary.
    • The time limit for bringing your claim could start to run from the date of the broker’s error or when the insurance was written (or should have been written), rather than when the broker’s error was discovered.

    How much will it cost?

If you would like DAS Law to help you with your dispute with a broker, there are a number of ways to fund your legal costs.

    Legal expenses insurance (LEI)

If you have a commercial insurance policy this may include LEI cover. If so, your legal costs may be covered by that policy, subject to its terms and conditions. If you are unsure if your insurance policy includes LEI cover, we will check this with you.

    Personal LEI

    No legal expenses insurance

Unfortunately we are unable to take on private instructions at the moment, and can only work with customers who have legal expenses insurance.

    What should I do next?

If you have legal expenses insurance with DAS, please call us on the number listed in your policy.

A broker may provide you with the wrong cover, or they may fail to purchase or renew that cover on time. If that causes you to suffer a loss, you may have a claim against the broker for compensation.
