Our legal process

We will discuss the issues that you are facing and give you an understanding as to how we can assist you. Where appropriate we will also give you an indication as to how long it may take to help you reach a resolution and the types of funding options that are available.

Following formal instructions we will review all of the paperwork and discuss in detail the case. We will then provide you with our assessment of how likely you are to succeed and a plan as to how we propose to get you there.

We will start communication with the other side to assess their position and appetite for resolving the matter. Reaching an acceptable settlement through early negotiation is our desired outcome; if this is not possible we will recommend another approach to you, which may mean starting formal legal proceedings.

Once we are engaged in formal legal proceedings it is difficult to commit to timeframes. We will, however, keep you informed as to our approach, the next steps available and the likely consequences of any approach or decision. At all times we will be giving you our recommendations and attempting to resolve the dispute in line with your aims.

It is very rare for a case to actually reach a final court hearing. If this does happen we will spend time explaining how the process will work and run through the likely questions. We will arrange for a barrister to represent you who will be comprehensively briefed by us.
