We will start communication with the other side to assess their position and appetite for resolving the matter. Reaching an acceptable settlement through early negotiation is our desired outcome; if this is not possible we will recommend another approach to you, which may mean starting formal legal proceedings.

Once we are engaged in formal legal proceedings it is difficult to commit to timeframes. We will, however, keep you informed as to our approach, the next steps available and the likely consequences of any approach or decision. At all times we will be giving you our recommendations and attempting to resolve the dispute in line with your aims.

Court hearing
It is very rare for a case to actually reach a final court hearing. If this does happen we will spend time explaining how the process will work and run through the likely questions. We will arrange for a barrister to represent you who will be comprehensively briefed by us.
